Cuda encoding colours off/green band/out of sync .ts to mp4/

Build 5223 x64

Cuda encoding

using a test file

.TS file
15Mbps 63secs size 116MB overhead 654%
video avc code 27 bitrate 14Mbps res 1920x1080 aspetc 16:9 pixel 1.01: frame rate 25.000 interlaced Tff
audio ac-3 bitrate 384 Kbps CBR channel 6 dealy -40ms

When encoding the CUDA setting are
profile: High
level 4.2
b-frames 2
preset custom (1920x1080)
CABAC
Deblocking
De-interlace

Audio
Format LC-AAC Nero Enc Def original TQ 67

I'm getting a green band across the bottom of the screen and all the colours are out of place not to mention the audio

What I'm aiming to do

Turn the .ts into a MKV/MP4 coping the audio using h264 cuda as encoder - shouldn't be to hard?
